All persons are treated fairly under the law. This is what persons in authority would like the public to believe. What happens in reality is different to what is touted in public forums. This essay shall argue in favor of the idea that men are treated unfairly in the court system when they are compared to women.

Men are unequally handled in the court system on issues of custody of children. Women are more than likely the parent to receive custody of children in the event of separation of a couple. This decision is based on old statistics that pegged women as the primary caregivers and men as the breadwinners, that women were the ones that stayed at home and cared for the children, and men went out of the house and brought in an income. The mode of thinking believes that women are the ones that are capable of raising children, and men are incapable of bringing up children. This idea is false because more and more women have entered the workforce, and left sole caretaking of children behind. There are some women who earn more than their male counterparts. One can then infer that women should not be given preferential treatment over men in the area of custody of shared children. Alas, we see here that this isn’t the case, and men are indeed unfairly treated in the court system.

In conclusion, men are unfairly treated in the court system in the area of custody of children when compared to women. Women are often the default parent awarded custody of children, which is a decision that is no longer based in relevant data.
